12、，數(shù)量： 臺。二、使用地點：十堰市經濟技術開發(fā)區(qū)方塊村甲方工地。三、設備用途：甲方工地土方工程施工。四、租賃方式：臺時租賃，柴油甲供。 五、租賃時間：根據(jù)甲方工程需要確定，退場時間以甲方通知為準。六、租賃價格：租賃單價為 元/臺時，柴油由甲方供應，乙方承擔租賃設備的折舊費、各種修理費、電費、司機人工工資、其它油料費用、設備進退場費等所有費用，協(xié)議實施期間不調整單價。七、租賃條件1、租賃期間乙方設備因工作需要消耗的燃油由甲方供應，因維修而發(fā)生的燃油由乙方自行承擔。2、設備的其它油料（如液壓油、機油、黃油、齒輪油等）由乙方自行承擔。3、租賃期間設備的維修費用及配件費用由乙方承擔。4、設備的調配使用
13、由甲方調度員協(xié)調安排，乙方應服從甲方對設備工作的安排。5、乙方提供的設備狀況應完好、手續(xù)齊全，燈光、儀表等裝置應保持正常工作。乙方設備工作能力必須滿足要求，乙方設備應配有技術熟練的操作人員，并且持有效操作證件，保證一個月最低工作240小時，否則按比例扣除租賃費。操作人員必須遵守甲方規(guī)定的作息時間，不準遲到、早退，服從現(xiàn)場施工人員的指揮。如設備性能或司機操作水平、素質影響甲方工程進度，或不服從甲方管理，甲方有權將司機或設備清退，乙方應及時更換人員或設備，否則甲方有權終止協(xié)議，因此給甲方帶來的工程進度損失由乙方負責。6、司機的食宿、水電費用、工資、獎金及其它福利待遇由乙方負責支付。7、乙方應嚴格要
14、求己方人員，不得在項目部施工現(xiàn)場或生活營區(qū)內酗酒、賭博、滋事，如發(fā)現(xiàn)立即清退，如違法，將提交司法部門處理。8、若由于乙方人員、設備不服從甲方調度管理，影響甲方文明施工及當?shù)卮迕窕虻谌叩纳a生活所產生的費用由乙方全部承擔。9、若乙方不經甲方允許，私自安排設備工作，發(fā)現(xiàn)一次罰款人民幣500元，并且賠償因此消耗的燃油費用。10、未經甲方同意，乙方不得隨意更換設備。替補的設備必須在原設備退場前進場，且替補設備在性能、狀況等方面必須滿足本條款第5點的要求。11、乙方因設備檢修或其他特殊原因確需暫停作業(yè)的，應提前一日向甲方提出書面申請，經甲方批準后方可暫停作業(yè)。12、稅金：營業(yè)稅、城市建設維護稅和教育費
15、附加由甲方承擔，其他稅費由乙方自行繳納。13、在租賃期間設備的使用權屬甲方，租賃期間車輛除正常檢修外，乙方車輛應停在甲方指定地點，應做到隨用隨到。每個月不設定最高工作時限，每天不設定最高工作時限。在生產中應發(fā)揮設備的正常功效（不能消極怠工），以滿足甲方的生產需要。八、甲方的權利和義務1、負責提供作業(yè)部位，安排乙方設備的工作。2、負責設備工作臺時的計量，及時為乙方辦理結算并支付。3、負責油料供應。4、發(fā)現(xiàn)乙方現(xiàn)場人員偷賣柴油時，甲方有權處罰。并處以偷賣油料價款的5倍罰款，要求更換司機或終止協(xié)議。5、甲方對乙方設備油耗進行測算（實測或設備臺時計算），油耗超過定額標準后（或乙方燃油被偷盜），費用由乙
16、方自行承擔。在辦理租賃費結算時，從乙方的結算款中扣除。九、乙方的權利和義務 1、乙方應遵守甲方有關機械車輛和人員的管理規(guī)定，并服從甲方調度的生產安排。2、乙方現(xiàn)場人員應遵守甲方有關文明施工的規(guī)定。3、乙方設備的操作人員應持有有效操作證件。4、甲方違章指揮時，乙方有權拒絕。5、乙方人員的用餐費、水電費由乙方承擔。6、乙方設備需要供油，應提前通知甲方油罐車，避免有效工作時間的損失。油罐車裝表計量，每次供油后，由乙方負責人員在油料供應單據(jù)上簽字確認。十、安全責任1、嚴格執(zhí)行機械使用安全技術操作規(guī)程和甲方下發(fā)的各項安全操作管理規(guī)程。尤其要確保設備操作人身安全。嚴格遵守施工現(xiàn)場交通規(guī)則，積極維護施工現(xiàn)場
17、交通秩序，保證施工現(xiàn)場道路的暢通和通行安全，不得亂停、亂靠，不得爭道搶行。2、施工過程中，非操作人員一律禁止進入駕駛室。車輛在行駛中或尚未停穩(wěn)時，嚴禁任何人上、下車。司機不得酒駕及帶病作業(yè)。司機離開設備必須將開關鑰匙隨身帶走，如設備發(fā)生被盜或人為損壞，乙方自行負責。如乙方未按本協(xié)議約定的安全管理要求，或因乙方司機操作不當和設備自身原因造成的安全事故由乙方承擔全部損失和費用。造成人員傷亡或機械及其它財產損失的，由施工作業(yè)駕駛員和設備所有人承擔全部經濟責任和相應的法律責任，與甲方無關。3、乙方對其施工設備向保險公司投保施工設備險，所需費用已包含在租賃單價中。出現(xiàn)意外事故后，乙方應直接向保險公司索賠
18、，甲方不承擔意外事故的任何賠償責任。4、乙方駕駛人員人身意外傷害險由甲方向保險公司投保，出現(xiàn)人身意外傷亡事故后，乙方積極配合甲方向保險公司索賠，保險公司賠付與實際賠償差額部分由乙方承擔賠償。5、乙方駕駛人員工傷險由甲方向保險公司投保，出現(xiàn)工傷事故后，乙方積極配合甲方向保險公司索賠，保險公司賠付與實際賠償差額部分由乙方承擔賠償。6、乙方必須無條件的接受甲方在安全上的監(jiān)督、管理及處罰，但這種安全上的監(jiān)督、管理及處罰并不能減輕和免除乙方在安全上應承擔的責任和義務。7、因甲方指揮不當造成的安全事故由甲方承擔全部損失和費用。8、乙方車輛發(fā)生的交通事故由乙方自行與交警部門解決處理，并承擔一切費用，與甲方無
19、關。十一、結算與支付1、計量：乙方設備工作時間，以雙方確認的計量單為準。如乙方不服從甲方指揮，或施工過程中不按甲方指令工作，該工作時間不予計量，乙方承擔責任并賠償該工作時間內發(fā)生的燃油費用。2、結算：結算日期以每月25日為界限，到結算日期時收齊單據(jù)，確認為有效單據(jù)后，核實加油量、工作時間，辦理工程量價款結算，如有燃油超耗情況，則按協(xié)議約定扣除超耗燃油的費用。3、價款支付：乙方需在甲方指定的銀行開設銀行結算賬戶，甲方將工程款匯至乙方賬戶。十二、本協(xié)議未盡事宜，雙方友好協(xié)商解決。若協(xié)商不成，甲乙雙方均有權將合同爭議向甲方住所地人民法院提起訴訟。 十三、本協(xié)議由甲乙雙方代表簽字蓋章后生效，雙方履行完
