Understanding law, legal system is theprecondition for understanding all the topics in this subject. So the first topicis of the most important one for the student to grasp. For Chinese students withno law background, it is more difficult to understand the common law system. So howto make the content of this part easy to understand is vital.Topic 2Crime is a concept different from the other offences. What is crime, the aim of thecriminal law and the process of the criminal trial is the starting point in thistopic. After the students having a rough understanding on those issues, then thewhite-collar crime is the key issue of this topic, which is also the difficulty partin this topic.Topic 3In this topic, both real property and personal property are discussed. The meaningof property, real property and personal property should be fully understood. Thenthe law on the land, including the ownership of land, the legal and equitableinterests in land, the Torrens title and general law, will be presented. Then thelaw on intellectual property is examined, which contains the law on copyright,designs, patents, and trademarksTopic 4Tort in the business world is another important issue in business law area. Thispart examines the definition of tort, the difference of tort with other crime,negligence and the damages of tort, as well as negligent statement. Tort is anabstract concept to understand, and there are many relevant concepts which are hardto understand, such as negligence, duty of care, reasonable man, etc. Only with fullyunderstanding of those concepts can the students know the tort in the business worldand the relevant laws on it.Topic 5Contract is one of the most important parts in business area. The regulation oncontract also differs greatly. This topic is also the most important topic for thissubject. The formation of contract and the enforcement of contract are the two mainparts. More time will be attributed to this part due to the significance of contract.The contract law under common law system differs a lot from our country, there arealso some abstract concept for the students to understand, such as consideration.Topic 6Sale of goods law, one of the important parts of business law, is put in this topic.The legal requirements of the Sale of Goods Acts and the parallel provisions in theAustralian Consumer Law are introduced at the beginning. Then the overlappingremedies against manufacturers for defective or unsafe goods or serviced (theproduct liability laws) are analyzed. The general consumer protection and thespecific consumer protection in the Australian Consumer Law are discussed.Topic 7In this part, the dispute resolutions in business area will be introduced, whichinclude litigation, arbitration and ADRs. The characteristics of each part, as wellas the advantages and disadvantages of each way will be analyzed.
